Lawfare after Trump’s first term didn’t work as the left had planned. So let’s up the ante! — 13 Comments

  1. The inmates (as they say) are in charge of the Democratic Party asylum.

Unfortunately, it’s been going on for far too long, but they’ve reached critical mass and, though there’ve been more than several episodes in the past—featuring, in particular, Soros DAs— they have now successfully lifted off into the criminally delusional destructosphere.

    Alas.

  2. Evidently, Yale Law School does not screen for sanity.

He’s rather de trop by the standards of Ohio Democrats and lost his seat in the legislature when he was bounced in a Democratic primary.

He’s never married, has no children. Some time after his birth, he was assigned by social workers to a pair of lesbians, both of whom were teachers. He grew up in Athens, Ohio, which is a university town. He appears to have spent about five years as a BigLaw associate, then burned out.

  3. one assumes red state Ahia will not succumb to the madness that put jay jones in power, but who can say absolutely, it does seem like every institution from the medical to academic to legal seems to ‘full of passionate intensity, and not in a good way,

  4. Good thing for this fool that Trump isn’t the monster they claim he is. If he was, this clown would just go missing never to be heard from again.

  5. Not only is he an example of ignorance, but how dangerous ignorance can be. And people like this (and Larry Krasner, for those of you who heard his little diatribe vowing to hunt down any members of ICE “like Nazis were hunted down” Not sure he meant how Jews were hunted down, or Nazis after the war) still don’t understand that WORDS MATTER. (Admittedly sometimes Trump doesn’t remember that and it gets him in unnecessary trouble) but freedom of speech does not mean you can promote violence. I think the words of Gov. Walz. and those of Jacob Frey in Minneapolis have been far worse than shouting “Fire!” in a crowded movie theater – the example used in Supreme Court definition of free speech. Free speech also does not include throwing items, impeding progress of federal agents, ramming and breaking into Fed’l vehicles, pushing them, setting off fireworks….I believe a lot of the behavior could be considered as forms of assault. But with police not helping, words of elected leaders exhorting such behavior, and letting people get away with what went on in Minneapolis, why would people differentiate between peaceful and not peaceful. Neo’s post gives us yet another example of what the “top institutions of higher learning” are producing these days. And I fear the younger students attending now, are much worse. And long before Minneapolis, going back to Trump’s first election in 2016, Senators and Congressmen and women were exorting violence. The shootings of Pretti and Renee Good are tragedies to be sure, but critical thinking necessitates asking what put them in the situations where what happened did. Renee Good was not innocently parked as if going to a store, and Pretti – what in the world was he thinking bringing a gun to these seething protests and extra clips of ammo, and then resisting arrest? From what I understand (and please correct me if I’m mistaken) though he had a license for concealed carry, the moment he started resisting arrest and fighting back against Fed’l agents, that license was null and void. The right to have a license means you have to know the laws regarding guns and the implicit responsibility to carry them within the law. To tell you the truth, this whole thing makes me so ill. Watching Mayor Frey, after having what Trump characterized as reasonable and fruitful conversations, then declare that “Minneapolis does not and will not enforce Federal Immigration Laws!” again indicates chaos when laws are not followed. Basic tenet of civilized society: law and order. I feel I also have to add that the episode of the person “attacking” Ilhan Omar (and I happen to detest her) was not much better. Hopefully the courts will take care of her. And maybe not. All too rare when Senators and Congressmen are held to account…which doesn’t encourage other citizens to want to obey the law. One last addition: if anyone saw John Fetterman’s intervies with Martha MacCallum on FNC was excellent. He’s turned out to be one of the most reasonable politicians with oodles of integrity I’ve seen in my lifetime. Huge surprise.

Nor, it seems, does Columbia Graduate School…

Garsh! Who knew that Gov. Grabbin’ Gavin could be so inspiring?!

  8. “…Watching Mayor Frey, after having what Trump characterized as reasonable and fruitful conversations, then declare that “Minneapolis does not and will not enforce Federal Immigration Laws!” …”

I did a mental double-take when I heard this. My first instinct was to begin suspecting that Mayor Frey thinks he’s being cute. Nobody is asking the mayor, or the municipal police force, or the sheriff, or the state police, to ‘enforce Federal Immigration Laws’. That’s neither their job, nor is it their privilege. They are not empowered to enforce Federal Immigration law, as far as I understand it. But they are required to abide by it, to work within it, and to cooperate with Federal authority as needs and circumstances demand – which is where they have been getting cute, with all their declarations of Sanctuary, and pretending not to understand retainer orders, or how inter-agency cooperation works.

But then, I am not a lawyer, and could easily be mis-stating matters. Any inputs?

  9. Forhan thinks he will be safe and secure and immune from the political violence he intends to unleash? Bless his heart.

  10. One notes that the real reason that she didn’t report it may be that she made up the story for advocacy purposes.

  11. Aggie commented on this @7:48pm: Watching Mayor Frey…. declare that “Minneapolis does not and will not enforce Federal Immigration Laws!” …”

This is true. We notice that the left is prone to think the worst of anything Trump says. We need to not fall into the same trap.

I was listening to a lawyer describe the principles that describe the relationship between the states and the federal government.

The anti-commandeering doctrine (from cases like New York v. United States (1992) and Printz v. United States (1997)) prohibits the federal government from forcing states to enact or enforce federal programs (e.g., no commandeering state officials to run federal background checks). Coercion via funding threats is a related but distinct limit.

The Supremacy Clause establishes that the Constitution, federal laws made pursuant to it, and treaties under U.S. authority are the “supreme Law of the Land.” State judges must follow federal law, and state constitutions or laws cannot contradict it.

Core effect: Federal law preempts (overrides) conflicting state law. This is the foundation of the preemption doctrine (express or implied).

States can withhold assistance (anti-commandeering protects this), but they cannot prevent federal enforcement (Supremacy Clause bars obstruction or nullification). The federal government enforces its laws directly when needed. This balance preserves federalism while ensuring national law prevails in conflicts.

What the Administration/Homan is trying to get Minnesota/Minneapolis to agree to is let the federal government into the prisons to take into custody people that have deportation orders and the city/county governments have arrested. They are refusing to work with the government, instead releasing these people back into the community, forcing the immigration LEO’s to find and arrest these people in the community.

So we know Frey (or Walz for that matter) aren’t going to enforce federal law. We hope that statement was made for his constituency, but they’ll agree to cooperate.

At least, that is how it was explained.

  12. Rich Lowry of National Review looks at a NY Times article “How Many People has Trump Deported So Far”

It’s only 10 minutes. The Times I imagine are looking at this to show how ineffective Trump has been in his first year, but by the numbers he’s doing as well as can be expected given the number of sanctuary cities/states that are refusing to cooperate with ICE, which wasn’t a problem for other presidents.
