Who might be charged for Russiagate, and with what?
There’s a lot of talk about the new Russiagate documents and whether anyone will be charged, if so who and with what, and what the chances of conviction might be. I came across this video yesterday. I’m not a Barnes fan, to say the least – I think he’s wrong on many issues. But I do think he’s usually very good on specific legal questions such as this. He seems to detest Pam Bondi, by the way. But as I said, he may be spot on about what charges the Russiagate perps might face. Neither treason nor sedition are among them.
Anyway, it’s worth a listen; it’s just a couple of minutes long:
As for the list of names, it’s unclear but it would probably include but not necessarily be limited to Clapper, Comey, and Brennan.

Bondi prosecuted George Zimmerman, even though the facts clearly showed it was legit self defense (which is why police didn’t initially charge him).
I think she did so due to pressure from the Obama WH. Obama clearly interjected himself in that case, which was the origins of Black Lives Matter.
So I think she lacks moral courage. Not something someone in her position should lack.
I think this is a big deal and also treasonous. However, I’ll buy that bridge in Brooklyn when somebody is actually charged and convicted. Otherwise…eh. I have lost all faith in the justice system for these jerks.

Well, I would not put much stock in analysis by people who look like the two pictured. Old Curmudgeon no doubt; but if people cannot bother to present a groomed appearance, it creates doubt.
I am so old, 90 years and 11 days, that I can remember when appearance was a measure of self respect; and the effort to be presentable was a mark of courtesy.

He can’t be charged now because he’s dead, but remember when the Steele dossier got out John McCain was going all around DC waving it excitedly (figuratively speaking) because he was sure they had the goods on Trump?
The safe way to bet is that anybody who is part of the uniparty establishment may have been involved. That is not to say that all of them knowingly committed crimes, but at least some of them did. Now that everybody in Biden’s orbit seems to be invoking their fifth amendment privilege I imagine we’re going to be hearing a lot of that and/or “I have no recollection of that.”

What is overlooked is that none of the participants can be convicted in DC or any other location where trials might be held.
A DC Jury will never convict a prominent Democrat. Jurors would have to be given new names and go into witness protection if they did such a thing.
Any cases brought to trial would just create a group of heroic jurors who had the courage to stand against Trump.

Richard Illyes: correct, but neither the DC establishment nor the jurors, living in the bubble they do, understand what the sentiment is around the rest of the country.
If a DC jury is thought by a large part of the country to have committed jury nullification, what then? Nancy Pelosi and the others in her party can bleat all they want about “our democracy,” but what happens when “our democracy” becomes nothing but a punchline, a joke synonymous with crooked elections and everybody in DC being on the take and not even bothering trying to hide it?
I would be pleased if federal trial jurisdictions were reconfigured, with metropolitan-statistical areas, micropolitan statistical areas, and unaffiliated counties as building blocs. Each jurisdiction would have a case load which could occupy at least six judges, with at least two specializing in bankruptcy (with other cases as filler), at least two specializing in criminal cases (with other cases as filler), and the remainder covering the rest of the waterfront. A jurisdiction enveloping a territory might also have family law specialists on its bench. The Washington jurisdiction might cover DC, about six counties in Maryland, about 20-odd localities in Virginia (counties and stand-alone munis), and a scatter in Penna and WVa. You could add a provision that no more than two jurors could be DC residents. The New York jurisdiction might cover all 19 counties around Manhattan with a provision than no more than 2 jurors could be a Manhattan resident. We need an outside auditor to make periodic inspections of the case assignment system. IMO, we might get fairer juries if jury questionnaires were employed to screen out people in particular occupations and people acquainted with one or another among the parties to the case and their counsel, but avoided voir dire and just selected jurors at random from among those who passed through the screens.

While were at it, can we require a preliminary hearing in front of a federal magistrate or panel of magistrates (some of which might require adversary proceedings) before a prosecutor would have leave to present a case in front of a federal grand jury?

I think Barnes missed his true calling as a prosecutor 🙂 Which is to say, he tends to leave out inconvenient information that might aid the defendants when discussing historical events. But I agree he can be informative when discussing the particulars of a given case.

Congratulations, Oldflyer.
Several decades ago the Fidelity folks guiding our retirement investment planning said we were of a cohort that had a 25% chance of living to 93, so it looks like you are truly beating the odds for your cohort (i.e., older than mine).
On Vance and his beard, perhaps by 2028 he can remove it and not look as boyish as he tended to earlier. But he is now showing some gray, and probably trying to project a level of wisdom beyond his biological age – and doing a pretty good job of it, I believe.
Not sure how and when and why this “scruffy” beard look took off, but if you are not sporting a beard at least 1/2″ long or longer, you probably don’t have the level of coverage that makes for a solid “male look”.
But Trump is anti-beard, and always seems very clean shaven. Has he perhaps had laser hair removal or something?
Not too worried about Obama.
He can always high-tail it to some place that doesn’t have an extradition treaty with the US—Indonesia? North Korea? Hawaii?—and live pretty grandly, all things considered…
The upside of all this is that Michelle can start despising America again….

As for charges against the “Three Mouseketeers” – Comey, Clapper, and Brennan – drawing and quartering is what I would prefer. But will accept loss of pension and a stiff jail sentence as okay, but barely.

Regarding loss of pensions: the arguments about being unprecedented, and/or “punishes the family” have always seemed like cop-outs. Intended to continue the problem of never enforcing accountability, and thus never decentivising the “deep state” recruitment.
I don’t care much for podcasts and videos. Call me old fashioned, but for one, I hate giving money (clicks) to the evil Google/YouTube. Also I prefer reading, so I can analyze the content, rather than being swayed by fast talking. “Believe half of what you see, and none of what you hear.”
The video-makers must have scripts which could be published on the web. I wonder if narcissism plays a part as well. Many of these people’s faces and personalities don’t appeal to me; I’d just as soon not have to see and hear them.
Barnes advances three (or more?) legal charges that could be brought. While the statute of limitations has run on other crimes, not so “conspiracy to obstruct justice” on which they all hinge.
Obama gets off for his official acts in office, but after then? Barnes tells us that aiding and abetting furtherance of the criminal conspiracy may well fit! Since Zero kept defending his cronies after leaving the presidency.
This all reminds me of the classic lesson from Watergate. Crimes were committed that President Nixon did not know about until after the fact. The subsequent coverup, however, did leave him open to criminal conspiracy to obstruct justice.
Such a similar fate for Zero sees poetic justice to me — perhaps as THE unindicted co-conspirator?
History sure does seem to be rhyming away just now.
PS to on, Oldflyer, etc. People are simply not appreciating that we have too many Rs who’ve been weak prosecutors like Trey Gowdy.

WE here need to rethink the bidder animus that Barnes pushes because, for instance, ge measures Congressman Gaetz focused and aggressive questioning of the Three Mousekereers-types in Congressional hearings as persuasive indication of his superior criminal justice powers.

I dunno Skip, seems to me prosecutors facing a collection of miscreants (gang, crime syndicate, etc.) have thoughtful aims to their procedures (“Ve haf vays oph making you tolk”) that will apply here as well. Often, I believe, prosecutors will work on underlings to elicit evidence with which to corner the top-men. Possibly methods (which in view of successful outcomes) require timely development.
The US Constitution defines treason specifically. Even the Rosenbergs were charged with espionage, not treason, because we were not at war with the USSR.
Russiagate and the Biden/Harris machinations were appalling and as bad as treason in my eyes. But not treason legally or at least constitutionally.
