  3. Jwm: Attorney General Bondi said that they are going to be charged under the Hobbs act which covers interstate commerce crimes. As a result, they will be tried in federal courts by federal attorneys, such as Essayli.

    Now that they’ve been delivered: Where exactly are they? A traceable transaction for an AG to investigate, and for witnesses to testify about – to a Grand Jury.

    This was written before the hearing–no question. It is filled with political rhetoric intended to create headlines

    One of the most offensive parts of Judge Breyer’s TRO is that it represents trial by news report.

    The Order is stuffed full of references to a couple of Declarations filed by California that attached a collection of news reports about the events of the day on June 7-9.

    He has taken this act based on a record created by the media.

    The correct thing to have done was to require California — the party seeking the TRO — to call witnesses to the events and provide him a record based on personal observations.

    What he relied upon instead was a record created by reporters as revised by their editors.

  7. Judge Breyer playing it real cute, saying “That’s the difference between a constitutional government and King George. It’s not that a leader can simply say something and then it becomes it,” U.S. District Court Judge Charles Breyer said during the hearing earlier on Thursday….”

    Stern, impartial language used a day or two before planned nationwide protests organized under the banner of ‘No Kings’, my, what a coincidence. I wonder if the judge has any, ahem, political affiliations of note.

I have to start by saying that I am 100% behind the deployment of the Guard and Marines as it has been carried out, and also 100% against Newsom and Bass’s anemic protestations that they’re for law and order, really! – but it does occur to me that funding or supplying signs for a protest (provided that it’s ONLY a protest) are not actions that violate any law, are they? (This is separate from the very enlightening money-following being done by DataRepublican and others.)

    Supplying weapons – prosecute. Training in attack tactics – I don’t know for sure, since you might be able to claim you’re just military hobbyists or something, but I would certainly try to prosecute that too. Supplying masks – I honestly don’t know how legally defensible Trump’s (and others’) forbidding of masks will turn out to be; I hate masks and believe that if you’re moved to protest in our country, you ought to do so with your face showing (I might think differently in countries where people really are “disappeared” for protesting).

    I’m trying to draw, and keep to, a distinction between unlawful activities and lawful if unsavory ones. And it’s not that easy a distinction to make, ISTM – intent, which is of course so difficult to prove, would seem to matter in some of these questions.

  10. The “peaceful protesters” are the sheep’s clothing the Democrat wolves use to embed their violent thugs, similar to Hamas hiding among civilians.
