Judge Merchan schedules Trump sentencing hearing for January 10
And yet he also seems to be signaling that the case will be discharged without jail or probation. If that’s true, why do this at all?
Simple, says Jonathan Turley:
The sentence will finalize the case and allow for an appeal. However, it would also label the President-elect a convicted felon just before he is sworn into office. It is the final cathartic act for lawfare warriors…
For many months, Democrats have repeated over and over that Trump is a convicted felon, as though that has any meaning. It’s lack of meaning isn’t just because until the sentencing hearing it’s not technically true – it’s because he was convicted by a kangaroo court and anyone studying the case objectively realizes that the conviction only condemns the Democrats rather than Trump.
However, this is also true as far as it goes, although dismissing the case would have been far better:
Merchan said that “while Trump could have faced up to four years behind bars on each of the counts, ‘a sentence of an unconditional discharge appears to be the most viable solution to ensure finality’ and [indicated he will] allow Trump to pursue his appeal options,” according to the Post.
The case has been a travesty from the start.
I still don’t think Marchan will let DJT off with just the convicted felon sign hanging around his neck, best guess is a few million fine.
We will see,
Someone needs to check into the Congressional hush fund money account. It would be interesting to see what the split is between D vs R.
Judge Merchan, a Democratic partisan, prefers Democratic lawfare over the non-partisan rule of law.
He is unfit for any judicial office.
But Democrats rule New York, city and state.
He serves as an an alert, a warning, to all American citizens: Beware of the Stalinist Democratic party.
This is the kind of BS that cost the Democrats the last election. Americans aren’t stupid, and they don’t like this type of nonsense that is little more than talkng points fodder for the ladies of the View.
So according to this BS from Merchan, if Trump had lost the election, he would definitely have sentenced him to prison.
I know several run-of-the-mill Democrats who are eagerly awaiting the chance to crow about a convicted felon being POTUS. They actually think they are scoring points with such. As far as I can tell the only ones who would care are their own left bubble friends.
Conviction over a non crime woohoo while every manner of ring wraith see the one that stabbed the mailman at a starbucks goes free
Trump, born in the 1940’s, would be found guilty by a present day NYC jury of killing Abe Lincoln in 1865.
There would be no DA in NYC that would hesitate for one second to indict Trump for this crime, and there would be plenty of judges that would relish presiding over this trial.
Reading between the lines here, I’m thinking Merchan is unlikely to be nominated to the SC during the next administration.
The purpose of the prosecution was to keep Trump from being elected. That failed, so now Merchan is cutting his losses.
I’m glad to see a sentencing, because I want an appeal. It’s the only way to clear Trump of this nonsense. I don’t see how the conviction possibly survives any kind of appeal. But I confess that the silence from the First Department on the appeal from the civil fraud case worries me. The oral argument was in September. Now we’re in January. I’m familiar with the Appellate Division, though less with the First Department than the upstate Third and Fourth. Decisions usually follow oral argument within a couple of months. It doesn’t take this long after oral argument to resolve an appeal unless there is some serious issue happening in the panel. What are they waiting for?
They did not strike it down as i understand the ny appeals are sisyphean
The judge is completely corrupt. His daughter being “paid” for campaign work is just like Hunter getting paid six figures for his “art”.
Or more likely his daughter is no different from Shiv Roy getting paid seven figures for “running “ campaigns when it was just done to get better coverage from Logan’s news network.
“Trump, born in the 1940’s, would be found guilty by a present day NYC jury of killing Abe Lincoln in 1865.“
Agreed
The Left will regret this.
There are something like six serious trial errors, any one of which would justify reversal with prejudice:
** Allowing Stormy Daniels testimony. The charge was falsifying business records — the cause of the falsification is irrelevant.
** Allowing Michael Cohen to testify that he pled guilty to the same charge — that is strictly prohibited due to its prejudicial effect.
** The indictment was fatally flawed, because it did not specify the felony that turned misdemeanor falsification into a felony, thereby extending the statute of limitations.
** The jury did not agree on which felony Trump committed that the falsification was intended to hide — the jury was evenly split on three different felonies. That is a gross foul.
** Bragg did not have jurisdiction to prosecute violations of federal election law.
** Merchan did not allow FEC testimony as to why Trump did not violate federal election law.
The whole thing was a star chamber proceeding that would have fit perfectly well in the Soviet Union. The amazing thing is that anyone at all thinks otherwise.
The NYC lawyers have shown us they can do show trials just as good as Stalin.
The sentence will finalize the case and allow for an appeal. However, it would also label the President-elect a convicted felon just before he is sworn into office.
Democrats have already been calling Trump a convicted felon, so the sentencing won’t change that. The voters obviously didn’t buy that, but the Democrats will continue beating that dead horse until it’s finally reversed on appeal (if it is–who knows with NY courts?). And probably even if it’s overturned they will still call him a convicted felon, since facts don’t really matter to them.
There is a severe winter storm moving east across the USA. It reached my house in SE Ohio about an hour ago. I’m hoping it will reach NY and shut down the courts by tomorrow. Would that convince Merchan to stop this travesty? Possibly not, but it might delay sentencing until after the 20th. I hope.
I believe sentencing him is the right thing to do. Otherwise he’s trapped in limbo. This is the only way he can appeal, and that’s the only way to get rid of the “convicted felon” nonsense.
Unfortunately, NYC is only supposed to get maybe an inch of snow. The wheels of “justice” will roll on.
They more or less _have_ to sentence, as I understand the law.
What is Merchan hoping for now? That’s guesswork. Possibilities:
1. Looking for a face-saving way out.
2. Hoping to stay ‘in good’ with the media and the Left with an eye on future opportunities (talking head shows, stuff like that).
3. So consumed with rage that he just can’t stop himself. Out of control.
4. Any or all of the above, maybe other stuff too?
Um, er, who is it that’s claiming Trump won’t be sentenced to serve time in prison?
(And why should we believe this, uh, person????)
File under: I will NEVER EVER pardon my son….
