Hunter Biden sues Giuliani for “hacking” the laptop hard drive that isn’t Hunter’s except when it is — 10 Comments

  1. But some versions of the hard drive circulated later appeared to have had data added after April 2019, a sign they could have been tampered with, according to reports in other media outlets, including The Washington Post.

This is poorly written. To clear things up, a “hard drive” doesn’t have a “version”. An image of the drive could have a version, which is probably what they were trying to say here.

At this point, the goal post moving has gone beyond absurd levels. First they claimed it was nothing more than Russian dissinformation, then they claimed it wasn’t Hunter’s laptop at all, now they’re saying it’s not even a laptop, it’s merely a hard drive. And what’s more this hard drive was “tampered with” by that dastardly Rudy Giuliani who is clearly a genius blackhat hacker!

What to make of this? On the surface it all feels like desperate flayling.

  2. Nonapod:

It might be. desperate flailing, but it serves to delay and obfuscate, which will probably put off any finding of guilt and make a few lawyers a whole lot of money. I despair of ever seeing justice served with Hunter or his father. This whole thing will just get dimmer and older, until voters no longer care and investigators retire or die off. Two systems of justice.

  3. I don’t see his privacy claim going very far. He gave up ownership of the hard drive (and the laptop it was in) by failing to pick it up on a timely basis. He has no excuses – he is apparently a Harvard trained attorney (hah!), who should have reviewed the contract with the guy fixing his laptop before signing it. (And, yes, there is very often an increased duty of care in this area for attorneys). Of course, he was likely drug addled the entire time – but that isn’t going to help him.

The one place I see him having a case is with copyright infringement (absent a provision in that contract to the contrary). His emails and the photos he took are presumably protected by his copyright. LEOs can probably claim Fair Use. Maybe not Giuliani.

  4. IF my friend Paris Hilton could not prevent the dissemination of her BJ given to a hairstylist that was left in an unpaid storage room… you can be darn sure that IF there is a modicum of sanity left, the judge will rule that what is yours is your to do with as you please, even if that is to play with what is actually there and actually your property. Given that no one is using his pics to sell coffee, and only for news, law, editorial, he is SOL (sh*t out of luck) on even using copyright law

and i would love to ask him…

Where was this non existent right to privacy that was not afforded the prior president in his stuff?

They be busy making circular firing squad…

  5. No matter what the charge, hope for a friendly judge and jury and collect.
Would bet California isn’t far off a DC jury in being friendly to a Democrat.
