  5. Cornhead: I kinda wish for “with prejudice” but an acquittal would do fine as well. Are we jinxing that by hoping for it?

    In any case, I think the Kenoshans should prepare for trouble. If I were a shopkeeper anywhere near the “mostly peaceful protests” that might erupt, I would just put signs on my storefront saying “Caution. Claymore Mines May Be Present. Have A Nice Day.”

  6. A dismissal with prejuice and a not guilty verdict would serve the same purpose. However, a dismissal with prejudice would ease a lot of pressure on the jurors, leaving them free to say “If he hadn’t dismissed, I would have voted guilty” in an effort to stave off the mob. Its easier to keep one judge secure than 12 jurors….

    Even without the prejudice amendment, it is doubtful the DA could refile…. unless he could find a whole new cast of witnesses that he could not find for this trial.

    I think this simple observation explains a lot of the country’s problems, but I’m not sure which way the causal arrows go.

    Donald McClarey, who has done a certain amount of trial work in 39 years of practice, has said the relaxed postures and lack of note-taking on the part of jurors indicates they’ve made up their minds. Hoping in the right direction.

    Judge seems to be leaning towards throwing out the weapons charge, with which Branca would agree. The report says the prosecutor was trying to get the judge to permit conviction on lesser charges rather than the ones on which the trial was conducted. Can they do that? The report says it seemed the prosecutor was admitting he hadn’t made his case.
