I’m referring to this news:
The [Chauvin] prosecution filed a motion to enhance sentencing, something we covered in Chauvin Post-Trial Sentencing: What to Expect. Chauvin opted to have the judge, not the jury, decide the issue.
The Judge just ruled in a six-page Order (pdf.) finding 4 of the 5 possible factors raised by the prosecution…
You can read the factors at the link, but in summary form they amount to the assertions that Chauvin was a police officer, that the death supposedly exhibited particular cruelty, that children were witnessing it, and that the perpetrators were a group.
These sorts of aggravating elements seem rather obviously to not originally have been meant to apply to a public situation in which police officers are trying to subdue a resistant perpetrator and had already called for EMTs, and were also using a form of restraint that had been approved (the only real question being whether they used it for too long and after Floyd had stopped breathing) by the department. One could argue that any group of police would be liable for aggravated circumstances sentencing under reasoning such as this. And perhaps that’s exactly the aim.
Note also that even the prosecutors have not alleged that anything racial was involved, even though that has been the main talking point around Floyd’s death and constitutes the main way in which activists have used that death to push for anti-police change.
This also puts to rest – for me, at least – the idea that Chauvin would have fared better in front of a judge. I very much doubt it.

Combine that with the fact that Chauvin apparently has to serve his entire sentence in solitary confinement — even at ten years, but now looking at 30 years — is already an enhanced punishment, even at the unenhanced sentencing rates which had been there formerly. That’s known as punishment time, the box, and something which other prisoners, convicted of far more horrible crimes for personal benefit, don’t get unless they do something terrible on the inside, and they do anything they can while on the inside, not to get. In Chauvin’s case, it’s only being meted out because the jailers cannot control their charges. That’s their failure, not Chauvin’s, but he pays for it.
Solitary confinement has been branded ‘torture’ by Amnesty International, particularly when extended, and has been known to drive people insane. In numerous cases, it’s been argued in court to be “cruel and unusual punishment.” They’re proposing 30 years of this? It doesn’t sound like a matter of the punishment fitting the crime, particularly given the flyweight sentences for far more damaging and malevolent crimes that other criminals are serving inside the Minnesota prison system.
I have read many times that Chauvin would have to be in solitary confinement, and I assume that’s correct. But I’m not 100% sure. However, if he isn’t in some form of isolation from the general prison population, there’s little doubt that he won’t be serving very long because someone will murder him.
But would the isolation necessarily be solitary? I read somewhere, quite some time ago, that police officers who are sentenced are sometimes put in a different part of a prison along with other police who are sentenced. However, because Chauvin has been turned into the equivalent of some sort of Hitlerian figure in a lot of people’s eyes, I’m not even sure that being incarcerated with other police officers would protect him. Maybe it would be even worse.
And how many imprisoned police officers are there in Minnesota right now? However many there are, I’m pretty sure there will soon be a few more – one or some or all of the tremendously unlucky officers who were with Chauvin on that fateful day.
All the left is succeeding in demonstrating is that you might as well shoot it out with them as surrender to the woke “justice” of the nihilist freak crowd.
The FBI and other termite heap agenices cannot catch everyone asleep at 4 AM.
Stoning would be too quick and merciful. The Left is looking for a slow-motion lynching in the courts and in the media.
Since we really no longer have a reliable justice system, I favor disestablishing police forces and issuing everyone who desires one a gun, or two. The anti-gun people can call in Therapists or Social Workers if they feel threatened.

Makes me think of the short story “The Lottery” and if you think about it, this whole Chauvin trial looks a lot like a ritual sacrifice to appease their pagan gods (who are never satisfied of course).

At “Legal Insurrection,” someone left a perceptive comment about what this tells us about Judge Peter Cahill: everybody wondered why he refused to grant a change of venue. Now we know.
Chauvin was saddled with an exhausted defense attorney, a mob of prosecutors in the courtroom, a mob of savages on the street, a mob of liars in the media, and a biased judge who worked religiously to avoid grounds for mistrial.
Conviction was a foregone conclusion.
This was a truly shameful episode in our country’s history.
JudgeExecutioner Cahill has embraced and then exceeded the jury’s guilt. Like Pontius Pilate, no amount of “washing of his hands” can absolve him of having ordered Chauvin’s crucifixion.Real sadists take their time….

My guess is that the intent of the law was to give extra punishment to perps who gunned down parents in front of their children, or something of that sort.
Not to mention the fact that Chauvin was innocent beyond a reasonable doubt.
That seems logical Neo, but what the heck is the judge thinking? His job is to disallow the nonsense. You don’t suppose the judge is making a backhanded effort to justify some reversals on appeal. Let the appeals court take the political heat.
I’ve heard many instances where court observers say that the judge desperately wants to avoid a reversal. But how often are there real consequences for the judge being reversed?

If he escaped from jail it would occupy the chattering classes for decades, like the Dreyfus affair.
Two men are still sitting in no-bail jail for supposedly murdering someone who wasn’t murdered, or possibly pepper-spraying him to death instead – except that he wasn’t pepper sprayed by them either. All for attending a protest that is called an armed insurrection, except there weren’t any arms and, judging from the charges rising into court cases, there wasn’t any insurrection either.
The Chauvin case is a lawful lynching, just as many other cases across the land are arbitrary selective legalized persecutions, to be juxtaposed for full effect against the obvious violent criminal felony behaviors of others that result in no charges being filed, and often no arrests being made, and if there are arrests, release without bail or bond. We are being shown just how much the future belongs to others.
Chauvin isn’t being stoned because that would be illegal.
This is precisely what the Left wants: to destroy Chauvin in such a way that, even though he as a hapless individual disappears into the justice system, we are left with the persistent image of him crammed into solitary until the last breath leaves his racist body. And well beyond. That is the meme these evildoers desire. His actual culpability is irrelevant; and has been since the moment he was first charged.
His fellow officers are no less vulnerable. In fact they may be more vulnerable than he: because the real agenda is, to demoralize the police. And what officer, studying the record of the Floyd catastrophe, is EVER going to stick out his or her neck? To hell with sticking out their necks: how about just doing their jobs?
Can they abort the baby, cannibalize her profitable parts, sequester her carbon pollutants, and have her, too?

So, we have known for years now, and it does not appear to be in dispute, that liberal Democrats are unhappier, more emotionally troubled and depressed, and more anxious than conservatives: despite that fact that so many of them are financially well-off, and ensconced in institutional sinecures.
When they reach a place they where cannot deny the fact, they wear it as a kind of badge of honor. All sensitive and feeling people are naturally angry and depressed when they think of the existence of the Bad Orange Man or those unfeeling Neanderthals who keep trying to escape to liberty, rather than being satisfied with license and applause now, and an eventually painlessly delivered death later.

Officer Mohamed Nur was convicted of murder 3 but he is only in for 12.5 years. Maybe they can be cellmates? I don’t know of any officer convicted for using a prone restraint that resulted in death–so could that be disproportionate punishment when he is the only one?
