How hard did the GOP try to stop the voting rule changes?
I see it everywhere now on the right, in articles, blogs, and comments – the urge to turn on the GOP in anger at its failure to fight effectively.
I feel it myself to a certain degree. The situation is extremely frustrating, and the rage so satisfying and familiar.
And yet I’ve seen this impulse before, and I’m fairly certain that it’s one of the things that does most to warm the cockles of leftist hearts.
Commenter “Aggie” states the case against the GOP here:
The legal battles to safeguard against absentee voter fraud should have begun last summer to set the stage properly before the counting started. I bet the seasoned pols all knew this; but it looks like they decided to stay quiet rather than suggest support preemptively. The gambit now, during election contests, is simply to fold arms, fade back, and watch.
Now Trump’s team is jumping through their ass fighting battles that should be handled by the bench. Important battles, lots of them – Signature Match arguments in all the key states, for instance – but the “A” Team should be reserving their focus for the Supreme Court confrontations that are coming.
The Republican Party hasn’t changed, the party of self-interested good losers with skin-deep principles who love the lifestyle. They can see that Trump is ready to miss a payment – and they want to get their mitts on that great ‘new car’ smell in the modern Republican Party. If they play their cards right, they can get it well under market value – they’ll just pick up the payments. They’ll market it as the New GOP, hitting the same Trump donor lists and demographic groups looking to score big by mouthing the words of the message without having to mention that dreaded name. They may be in for a surprise.
My first response, however, is this: are you sure they didn’t try to fight prior to the election? After all, most of the changes – the loosening of the rules – were squeezed in during the last few months with the argument that it was necessary to protect people from COVID. However, the usual absentee ballot system was already available for those who really felt they could not brave the polls, and others certainly could have gone with proper distancing and other safeguards. Some states did it that way and there was no problem. In the states that did make changes, the changes were quite last-minute and done under cover of the COVID scare, but there certainly was opposition by the GOP. There were several cases involving PA, for example, that went all the way to SCOTUS, which decided to let the lower (Democrat) PA court’s ruling stand.
There most definitely were challenges in other states as well. See this article from August about various challenges in which the RNC was involved. This was a GOP challenge to mail-in voting expansion in Illinois. This was a challenge in Houston. There was also one in California, one in Nevada, another in North Carolina, one in Michigan, and even in Montana. That’s by no means an exhaustive list, either.
I don’t know the disposition of all the cases, but I also recall reading about some were won by the GOP and of course there were some that they lost (the latter especially in Pennsylvania). The lawsuits are a likely precursor for what will come afterward. Republicans say they have retained outside law firms, along with thousands of volunteer lawyers at the ready. Democrats have announced a legal war room of heavyweights, including a pair of former solicitors general.
The race is already regarded as the most litigated in American history, due in large part to the massive expansion of mail and absentee voting. Loyola Law School professor Justin Levitt, a former Justice Department elections official, has tallied some 260 lawsuits arising from the coronavirus. The Republication National Committee says it’s involved in more than 40 lawsuits, and a website operated by a chief Democrat lawyer lists active cases worth watching in about 15 states.
Democrats are focusing their efforts on multiple core areas — securing free postage for mail ballots, reforming signature-match laws, allowing ballot collection by third-parties like community organizations and ensuring that ballots postmarked by Election Day can count. Republicans warn that those same requests open the door to voter fraud and confusion and are countering efforts to relax rules on how voters cast ballots this November.
“We’re trying to prevent chaos in the process,” RNC chief counsel Justin Riemer said in an interview. “Nothing creates more chaos than rewriting a bunch of rules at the last minute.”…

That includes Ohio, where a coalition of voting groups and Democrats have sued to force an expansion of ballot drop boxes from more than just one per county. Separately on Monday, a federal judge rejected changes to the state’s signature-matching requirement for ballots and ballot applications, handing a win to the state’s Republican election chief who has been engulfed with litigation this election season.
In Arizona, a judge’s ruling that voters who forget to sign their early ballots have up to five days after the election to fix the problem is now on appeal before the 9th U.S. Circuit Court of Appeals.
A federal appeals court on Tuesday upheld a six-day extension for counting absentee ballots in Wisconsin as long as they are postmarked by Election Day. The ruling gave Democrats in the state at least a temporary victory in a case that could nonetheless by appealed to the U.S. Supreme Court. In neighboring Michigan, the GOP is suing to try to overturn a decision that lets the state count absentee ballots up to 14 days after the election.
In battleground North Carolina, where voters are already struggling with rules requiring witness signatures on absentee ballots, the RNC and Trump’s campaign committee have sued over new election guidance that will permit ballots with incomplete witness information to be fixed without the voter having to fill out a new blank ballot.
In Iowa, the Trump campaign and Republican groups have won a series of sweeping legal victories in their attempts to limit absentee voting, with judges throwing out tens of thousands of absentee ballot applications in three counties. This week, another judge upheld a new Republican-backed law that will make it harder for counties to process absentee ballot applications.
Pennsylvania has been a particular hive of activity.
It’s been hard to keep up with all the news, both pre- and post-election. But just because you didn’t hear about something, that doesn’t mean it didn’t happen. There definitely was some fighting in the courts, although it was nowhere near as successful as we would have hoped.
As I’ve already indicated, I have my own quarrels with the Republican “establishment” and certainly with the NeverTrumpers. The Georgia Secretary of State, Raffensperger, seems a particularly good example of a worse-than-useless GOP official who agreed to changes that enhanced opportunities for fraud. See this:
Back in March, Georgia election officials agreed to a settlement in federal court with the Georgia Democratic Party, the Democratic Senatorial Campaign Committee, and the Democratic Congressional Campaign Committee, which had sued the state over its rules for absentee voting….
Previously, the signature on the absentee ballot had to match the signature on eNet, a computer database that maintains Georgia’s voter registration and absentee ballot information. If the signature on the ballot didn’t match, it was thrown out.
In a cleverly worded section of the settlement, Georgia election officials agreed to a subtle but profound change. Instead of having to match the signature on file with eNet, the absentee ballot signature only had to match the signature on the absentee ballot application. The key word in the settlement was “any.” That is, an absentee ballot can only be rejected if it doesn’t match “any” of the signatures on file—either in eNet or the signature on the absentee ballot application.
The situation is different in each state, but Georgia seems to have been an especially egregious example of Republican caving – perhaps because of the Stacey Abrams factor. Georgia remains an enormously key state because of the pending runoffs there, and if nothing changes to tighten up the election rules it doesn’t bode well for the results.
[NOTE: And speaking of Georgia, Dominion’s server just crashed during the latest recount. But recounts there are somewhat futile, anyway, because there are many other problems such as the signature match vulnerability described in the quote above, which cannot be corrected by a recount.]
Jim Jordan of Ohio was sounding the alarm about the chaos and the confusion of mass mail-in ballots several months before the election, but his warning seems not to have been taken to heart, and he is (alas!) one of the not very numerous Republicans in Congress with genuine courage. One suspects both that Raffensperger and Kemp are typically spineless GOP swamp-creatures, and that, because of the influence of S. Abrams, they are terrified of being accused of “racism” and of “voter suppression” should they make any effort to ensure that the upcoming election in Georgia be as free of abuse and fraud as possible.
I wonder if there are any active democrats, even one… who realize that the right is not just trying to preserve the consent of the governed but trying to prevent another civil war?
Do any of them realize that shoving blatant and effectively permanent disenfranchisement, in the faces of 80 Million American patriots… will result in them paying a terrible price?
Second guessers have to second guess.
I know we are all frustrated. Personally, my emotions revolve between rage, depression, and apathy.
But, I have no idea whether the legal challenges were well thought out, or well executed. As you just said, it was/is very hard to keep up with developments. In the first place the media now censors anything that favors Trump, the GOP or Conservatives. So, why would anyone think they knew the scope of the effort?
It looks like the Democrats will be able to run out the clock, since there doesn’t seem to be any Court that is interested in protecting the legitimacy of our elections. They are making a mistake, because my information was that 73,909,083 votes were actually counted for Trump (Hannity says more but it is Hannity so probably exaggerated.). That is a lot of potentially furious people.
I will probably send another donation to the Georgia duo, as much to salve my conscience as anything. I am hopeful that I will still be around to watch Pelosi’s eviction from the Speaker’s office in January 2023. (Or maybe it will be AOC) At this point, looking toward November 2024 is a bit problematic for me. If I am still around, I sincerely hope that I am more mentally alert than Biden.
It would be interesting to see a comparison of the efforts made by Mark Elias and Lawfare (Democratic Party extension) versus the list of efforts made by the Republican Party on this subject in 2020, and some commentary on the relative scale and effectiveness of the efforts up to Election Day. From what I see, the Republicans have been outclassed on this field.
But now, during the heat of the vote-counting battle: How many of the big name Law Firms specializing in Election Law have backed away from representing President Trump in post-election lawsuits, leaving him with a team virtually without experienced talent and requisite depth? Is it all of them yet? All of them squirming because someone on the Left said mean things about them, and made threats? Are Law Firms unaccustomed to being on the receiving end of intimidating tactics?
How many of these Law Firms would dare decline to participate if the Republican Party, which is in ascendancy now nationally, was equally or even more ruthless in twisting their arms and reminding them of their best interests? Actions: They count. Overall, I wonder how many Signature Match arguments or lawsuits have been filed by the Republican Party ( I have heard of one or two in PA)? Robert Barnes seems to see this as the key, with getting the courts to engage at all as one of the biggest obstacles.
There are some in the party that are supporting Trump the best that they can, but I only conclude, from the lack of visible activity, that most Republicans can’t wait to see him go so they can return to the comfort of unchallenged status quo with plenty of gravy. If Senators and Representatives were on the soap box daily raising holy hell about election fraud, there would be interest. And yet…..Gosh, Ted Cruz and John Cornyn are awfully quiet, here in Texas. Haven’t heard a peep on supporting election lawsuits. Ted’s got some brave things to say about preserving the Thanksgiving holiday though, and some tough talk about wearing masks in Congress. Cornyn just got re-elected and so he’s already gone, moving right on past concession to offering criticism of Biden’s personnel choices.

I don’t necessarily think it is accurate to say that Republicans were outclassed in the field. The Republic establishment did not take the field. I think we would agree on that.
We had ample evidence before the election that great swaths of the activist GOP were perfectly content to see Trump defeated; and many high profile members openly advocated for that result.
I don’t know what to do about them I detest them; but, as of now there appears to be no viable alternative. A Trump, to put it in a metrological context, is a “hundred year storm.”

Incidentally, one other point of note: We have some relative newcomers in the halls of Congress, who got there on Trump’s coattails implicitly by advocating his message to their constituents; they have staked positions wholeheartedly defending Trumpism. But: What is going to happen over the next two years? Their sponsor, defender & protector might be gone, and these wee Congressmen and Congresswomen will find themselves caught out as red-headed stepchildren in a family where they’re either hated or simply despised, depending on the party affiliation of their colleagues. It will be interesting indeed to watch the moves, see who is politely disenfranchised from key subcommittee positions of power and authority, who is actively shunned by all parties. If Trump is defeated it won’t be good to be a standard-bearer of his message in those hallowed halls.
We need a viable third party, don’t we? Bull Moose redux perhaps, funded by the Trump war-chest, wrested from the sweaty clutch of the Republican Party?
Arizona has a RINO governor who went out of his way to avoid doing anything that would Stop the Steal. It also has (had, rather) a RINO Senator who couldn’t even last a full term before surrendering our state’s entire Senate delegation to the Democrats. Yes, I see Trump doing all the heavy lifting here, while the GOPe sits back and waits to return to business as usual… but they’re going to get a rude awakening. If they can’t be bothered to fight for themselves, I’ll certainly never trust them to fight for me.

I agree that many Republicans are indeed RINOs or never really backed Trump during his tenure. But I don’t think it’s the majority. In addition, you are demonstrating when I was referring to when I wrote, “just because you didn’t hear about something, that doesn’t mean it didn’t happen” (the “you” there isn’t meant to refer to just to you personally; it’s the general “you”). For example, how do people get the word out at this point? If the MSM won’t cover much of what they say, and if Twitter censors talk of election fraud, how would you know what they’re saying? You have to search for it. Seriously, it’s not easy to get word out anymore, but that doesn’t mean they’re not speaking on the subject.
For example, if you Google “ted cruz on election fraud cases” and limit the search to the time since the election occurred, you’ll get a bunch of articles saying that Cruz is defending Trump’s suits that challenge the election. The Dallas paper:

I doubt their support of Trump was as full-throated (Cornyn’s hasn’t been, lately) as you might want, but they certainly have not turned on him or endorsed Biden as the winner, and many have continued to back Trump.

I repeat: there are Republicans who are not supporting Trump. But there are plenty who are, and it’s not easy to do a full head count. But I don’t think anything is served by these blanket condemnations of “Republicans” as a unit. It’s important to do the research to find out who has actually said what. Only the left profits from the right turning on those who don’t deserve it. I think there are more constructive things to do with anger.

Arizona had more Republicans voting by mail than they did Democrats and they have been voting by mail there since the 1990’s. In 2010 for the first time more voters voted by mail than vote in person. For years the Arizona Republican party has pushed voting by mail as a safe option. Voters have to request a ballot in advance much like absentee voting. Signature matching is a must.
This year over 85% in the state voted by mail.
The election numbers were actually the opposite of MI, PA and WI. On election night Biden had a 130k vote lead. 25 days of counting mail-in ballots later Biden had only a 10k lead. Yes, Trump gained ground there from mail-in ballots, but you don’t hear that narrative.
Mail-in voting works as long as a good set of rules are established as they are in AZ – which has been a Republican run state for years. It just so happens that this year more Democrats voted in person than Republicans. Odd but true.
Many in AZ want to continue mail-in ballots. It works well there.

Neo, I haven’t ever disagreed that there are many Republicans protesting the election results generally and defending Trump specifically. But the news reports you link to are from Nov 8th and Nov 10th, respectively – and the one on the 10th is headlined with Cornyn already distancing, almost 3 weeks ago. Now, I don’t mind digging for my news – I’m retired and can make time for it. But most people simply cannot, either because they are busy with their kids or don’t know how to research the internet, or they cannot make time with what they have at hand.
So I go to the GOP.com website tonight to see a pop up offering me a Trump 2020 yard sign. Then another pop up telling me the COVID vaccine is coming soon! Then another requesting me to Join The Team and make a monetary contribution. Not a single story, video, blog or update on Election Fraud 2020 is there at the GOP Home Page. No strategy statements by spokespersons; no updates on contested states or districts; no list of lawsuits or related activities; no messages of confidence and stay-the-course. In a world where accurate and fair reporting on GOP issues is hard to come by, this is the Establishment GOP’s best effort? If they wanted to have money rolling in, shouldn’t they at least be maintaining an up-to-the-minute status on the state of play?

They are facing 73-plus million disenfranchised voters who are stinking mad – and instead of priming them with news and information to generate interest and hold attention and to help fund-raise the efforts, instead of consolidating their public opinion megaphone, to embarrass hacks like the Georgia SOS and Governor with a virtual Republican mob – instead of harnessing this raw populace power, they coast and leave it to others, many of them at the grassroots level – in my opinion.
How is that possible? How is it possible that there is no organized Establishment GOP-run clearing house that video links every single hearing in every state that is contested, that has vote tallies, that has a list of disputes and lawsuits? Is it not important enough? The party seems to prefer that their supporters work hard to get their news, from places that are mostly unsympathetic, even hostile to their cause.

Anyway, I couldn’t care less what Democrats think. Gloating at Republicans dismayed with their party’s inept election contest is 10th order priority for them, at the moment – they still have an election to steal and make official, and plans to lay for when they win. I am one who is dismayed, but that doesn’t mean I’ve given up – there is still time for things to happen. However, it does mean that I’m not going to waste faith expecting something from the Republican Party that it cannot bring itself to produce. It’s not going to be good enough, the Republican Establishment’s response – because it cannot compete. And that is something that a lot of voters are not going to forget: Their votes were devalued and then they were liquidated, in a process that seems mostly unfair and seemingly across a spectrum of illegality. And as far as they’re concerned, how this happened remains inadequately explained by their party, in the face of some pretty condemning evidence.

I approve with caveats.
Were Trump to declare Martial Law before SCOTUS has ruled is politically, extremely problematic.
If SCOTUS rules in favor of Biden… Trump declaring Martial Law is unlikely to be backed by the upper echelons in the military. I don’t see how Civil War is avoidable at that point.
I’ve repeatedly stated that IMO that if the S.C. rules against the fraud, only Trump can stop another civil war by taking measured steps in response to the riots that will erupt upon the SCOTUS ruling in his favor.
Those steps would start with his invoking the Insurrection Act.
At each step, Trump must have Constitutional justification for his measured actions.
Invoking the Insurrection Act will not stop the riots, in fact its likely to exacerbate them. Which strategically, is desirable as that will allow Trump to declare Martial Law, suspend Habeus Corpus and start military trials with charges of sedition, insurrection and treason.
The net Trump casts must be as widespread as possible and across every institution. In order to gut the left, thousands must be charged and sentenced. Executions for direct treason. Imprisonment with loss of citizenship for those convicted of sedition and/or insurrection.
I want him to be ruthless but within a Constitutionally valid rationale.
Once he’s cleaned out The Swamp, then demand and implement an Article V Convention. That is where Constitutional reforms can be adopted that directly address the tactics the left has used both in their March Through the Institutions and in their using constitutional safeguards to attack America from within. Start with outlawing support for every totalitarian ideology.
The Republican party is hopeless. If Trump leaves the White House in January, he can start a new ‘Patriot’ political party and take his 74,000,000 supporters with him. Then start targeting RINO’s in primaries. Use his rally/grass roots strategy to build support for candidates that support Constitutional conservatism, America first and – most important – election integrity.

We’re waiting for SCOTUS to rule. The majority in the S.C. will either act to save the Constitution or stick a knife in its back. If they engage in legalisms, then no other recourse remains but “politics by ‘other’ means”. But don’t look for law abiding patriots to act until they’re told to get on their knees. It’s cool heads that are needed now, a civil war is not something to embrace lightly. Only race and religious wars are more terrible.

The Republican Party has been damaged by this election, because they put a lot into it, and (except for winning house and state races) didn’t grab the brass ring. What I would like to see the party do now is begin to prepare the battle space for the next election. It is grueling work, but it has to be done.

Newton’s theory of gravity is incorrect, not his inertia and vector laws mathematically speaking. The theory of gravity, backed by Einstein’s relativity and Newton’s math, is unprovable in calculus. Newton himself failed to mathematically work out his 3 body problem. Because a center of gravity for each mass pulls on every other center of mass, for gravity, there should be a calculus equation, a general equation, that predicts what goes on between 3 bodies pulling on each other. Newton could never solve this, because it always ended up as a chaotic system. The solar system, however, is not chaotic. This was the first and fatal block in Classical Newtonian physics. Einstein patched it up, but that wasn’t enough given other problems like galaxy spin rates.
So now their excuse is “dark matter”. There’s too much gravity, but not enough visible mass, so let’s pretend there is invisible matter doing the gravity instead.

This is called arbitrary enforcement of “rules”, which means they aren’t really rules and thus absolves me of the need to follow the fictional justifications.
