HUD’s heavy hand
The Obama administration is going forward with its plan to engineer local neighborhoods through the executive branch.
I wrote about this before at some length, here. It’s a policy that would be highly unlikely to pass Congress, so it’s being done through new HUD rules.
The 1968 Fair Housing Law, under which the power to do this supposedly comes, was only meant to bar outright discrimination. But (as with most such agencies and most such laws) what was once a focus on equality of opportunity has become a demand for equality of outcome. Whether or not actual discrimination is taking place has become irrelevant; the administration is serving notice that de facto divisions are not okay anymore:
The new rules, a top demand of civil-rights groups, will require cities and towns all over the country to scrutinize their housing patterns for racial bias and to publicly report, every three to five years, the results. Communities will also have to set goals, which will be tracked over time, for how they will further reduce segregation…
Officials insist that they want to work with and not punish communities where segregation exists. But the new reports will make it harder to conceal when communities consistently flout the law. And in the most flagrant cases, HUD holds out the possibility of withholding a portion of the billions of dollars of federal funding it hands out each year.
HUD giveth, and HUD taketh away. And don’t think this is the end of it:

This was also made possible by the SCOTUS ruling in Texas Department of Housing, a decision from a few weeks ago that I wrote about here. If that case—which was decided, as so many are these days, by a 5-4 tally, with Justice Kennedy casting the deciding vote—had gone the other way, this would not be happening.
Local control will go by the wayside:
Civil-rights groups say that fair housing is about removing the constraints on the housing market ”” such as zoning laws that bar apartment construction in the suburbs and formulas that ensure affordable housing is built primarily in poor neighborhoods ”” so that lower-income and minority families will have more options. Conservatives see the rule, instead, as government intrusion into a market that is already open.
In his ruling in Texas, Kennedy warned to be careful:
He cautioned, though, that “disparate impact” claims don’t simply arise any time statistical disparities appear along racial lines in housing. It must be clear that housing policies caused that disparity, and that those policies don’t serve another valid goal.
The decision upholds a legal strategy that civil rights groups and the federal government have used for four decades to fight lending practices, local housing policies and zoning laws that have had the effect of limiting housing options available to minorities.
Does anyone believe that Kennedy’s warning will be respected? I don’t; that’s not the direction in which these things tend to go.
Meanwhile, this is an excellent observation about the danger of accepting money from the federal government. Money means control by the one dispensing it, loss of control by the one accepting it:
Westchester County, New York, has been mired for years in a legal battle with HUD, thanks to a lawsuit claiming that the county misled the government by accepting HUD funding without affirmatively furthering fair housing.
The county agreed in a 2009 settlement to build 750 new affordable housing units, primarily in communities with few minorities. The settlement also required the county to adopt a law banning landlords from discriminating against subsidized tenants. As some of those benchmarks went unmet, HUD began to withhold money from Westchester. The county has since decided not to pursue any more block-grant funds, an option critics of the new rule warn many communities will chose.
“It’s not worth it because of the threat of lawsuits, the strings attached, and the control that Washington can then exert over you,” says Westchester County Executive Robert P. Astorino. “You get involved with the federal government, and you can’t get out of bed with them.”
People, black white or purple, want to live in neighborhoods that are low in crime and attractive if they possibly can, and if they have enough money they will pay to do so. If they don’t they can’t, but one of the many reasons most people aspire to making more money is so that they can have a nice place to live.
Another thing that tends to be important to people is being able to make rules about the sort of environment in which they are living. Communities that ban apartments want to—get this—ban apartments. Sometimes they want to ban high-rises. If they want to ban rental housing, and if that means they want to ban housing for low-income people, black and white, well then so be it. Such a ban would be a case of Justice Kennedy’s “serving another valid goal”—but how long will that attitude be allowed to last?
America has always had a tradition of local control. People used to—and I believe still do, at least most of them—find that precious. It’s not just a white thing, it’s an everybody thing. But this administration is determined (with the heartfelt assistance of the Supreme Court) to end that. And the more accustomed people become to not having control over their own lives, the more they will accept it as normal to not have control over their own lives.
For our own good, of course. After all, who needs autonomy?
[NOTE: The House has already passed a bill to defund enforcement of these new rules. Will the Senate follow suit? And will that actually stop implementation of these rules? Plus, of course, I can see the headlines now: “Republicans further discrimination against poor black people; block remedy.”
Also, this article points out that these new rules are a back door way to introduce more Democrats into Republican districts. While that may sometimes be the case, I’m not so sure how often it is; for example, Westchester went resoundingly for Obama in 2012 but had gone even more for him in 2008, before the HUD housing intervention happened there. The rules might even have the effect of creating a backlash against Democrats, I suppose, if they end up impacting people’s communities in a way they notice. Of course, by then, President H. Clinton already may be firmly in place.]
[NOTE II: I have a piece in the hopper on SCOTUS appointments and the phenomenon of Republican-appointed justices who move towards the left in their voting habits over time. I’m uncovering some fascinating stuff, but it’s a big topic and it’s taking longer than I thought. Justice Kennedy, appointed by Ronald Reagan, is one of those people. The story of how Kennedy came to be nominated is a complicated one, but the simple version is that (1) Democrats controlled the Senate; and (2) it happened right after the Bork debacle and the failure of Reagan’s subsequent nomination too (Ginsburg).
However, if it’s any consolation (and it probably is not), even if Bork had been on the Court all this time, he died in December of 2012 and Obama would have appointed his successor, probably a young person with many many years ahead of him/her. At least this way, Kennedy is already 78 years old.]

BTW, in your diggings re the “phenomenon” (I think it too predictable to not warrant the scare quotes) of Republican-appointed justices who move towards the left, have you come across the genuinely phenomenonal, the Democratic appointed justice who’d tacked right?
This is certainly true, but the problem with such social engineering is that bureaucrats can not make decisions based upon quality, only upon skin color and economic level. The result is that they oftentimes move people who are the cause of an undesirable neighborhood into an otherwise attractive neighborhood making it less desirable as a whole. It’s like helping top pollinate a cancer. It’s like the claim of socialism being shared poverty.
Furthermore, has anyone noticed the conundrum here? The left idolizes “diversity”, yet emphasizes the importance of alternative (non-Western, especially non-American) culture. Wanting to be part of the mainstream American whole is the glue that holds this diverse country together. The left and the social engineers (but I repeat myself) want to create diverse neighborhoods yet simultaneously dismiss and disparage the common bond that allows them to prosper.
I live outside Reston, VA, a planed community. At first they included low rent housing in the development and imported poor people. They quickly discovered these people weren’t very desirable neighbors and had a tendency to turn their dwellings into slums. They pretty much stopped building low rent housing. You can take the people out of the slums but that doesn’t change their behavior.

However, I have found a number of reasons why this right-to-left movement is so, and some of them are a bit surprising. I also have some theories of my own.

I have to admit some schadenfreude on this one. For years HUD has been subsidizing rents for welfare recipients to move into working and middle class neighborhoods. Now they’re aiming at upper class neighborhoods–where people vote Democratic and think themselves enlightened because, why, they’d accept any minority with a Ph.D. who wanted to move in. Now they’re getting a taste of what it feels like to watch your neighborhood fall apart.
Not being content that Detroit, Baltimore and Philadelphia are lost beyond redemption, HUD has set out to expand the same perdition ever farther afield. There will be no rest in that government department as long as regions of tranquility and safety endure. I think the proper response to this mad social engineering would be for Texas and Arizona to begin gathering whole busloads of illegals as they come across the border and transporting them to downtown San Francisco and Seattle.

I don’t think it’s really all that surprising that most of the justices who started out conservative moved toward liberal over their time on the Court. To resist the pull of societal changes, it takes more than a moderate conservatism, it takes a true believer. Which is what Thomas, Scalia, and Alito are.

as i have said over and over again, the mass of things going on since just the 1980s is so large that no one would read my posts… not that many do anyway…
you only have to know what to lookup and what to know in terms of these programs and things and who was fighting for them.
after all, the hud thing even if you read hud, is mostly about welfare women, not men… the men come along and live on the streets the women get EBT, aid to dependent children, living space, etc.
this has been in the works for decades, but until its change is enough that people perceive it, it stays hidden until some line is crossed and they wake up. to try to tell them before, gets you crapped on… now telling them gets them incredulous as they missed all of it.

Not always. People are still studying what is happening with section 8… but so far its looking like people self select to live by people in the same socioeconomic class… even if its a less nice and higher crime. Which unfortunately; cut down on some of the hoped for benefits from section 8.
While on the unexpected results bandwagon… I say let the left do this… heck; help them do it. Sorta like when republicans proposed expanding social security to the middle class and all the dems jumped on. What was that percentage of African Americans and Hispanics needed to switch to being republican voters do we need to put down the democrats? Assimilating them to middle class values is one way to get a boost (even if its only 30

Towards Neo’s (and other’s) theory of Justice right-to-left movement, I blame the fact that Roberts reads (and apparently Believe’s) the WashPost. But the Right Court does not read the Com-Post (as Rush labels it).
Similarly, UCLA’s Tim Groseclose studied Congressional District voting patterns before Fox News Channel debuted on cable TV, and after.
He finds that without the media bias’ impact on US voting patterns, there would be no Democrat presidents elected for decades.
Furthermore, he finds that US voting at the national level would be more like Texas or Tennessee than the close and herd-minded results we are all too familiar with, seemingly forever.

One of the reasons housing has become so expensive is you have to spend a lot to stay away from high crime and poor schools. Thus, people bid up the attractive neighborhoods.
The irony of this is many middle class blacks have moved out of the city to get away from the great unwashed, and they would be impacted by low income people being moved in by the Democrat government.

I was wondering how rich black people count in the HUD diversity game. In other words, in a wealthy neighborhood that is mostly white, of course there are going to be black people who moved there because they had the money to afford it, and because they want a pleasant, attractive, and safe neighborhood with good schools. So, when HUD is crunching its numbers, do they count as diversity (“black”) for the purpose of HUD, or do they count as homogeneity (“rich”) for the purpose of HUD?
Because if it’s the former, then residents of rich communities that don’t want HUD with its heavy boot on their necks ought to encourage a lot of rich black people to move there.

While technically, this isn’t subsidizing their move to a pricier neighborhood, it will have the same effect. You can’t give someone a home in a middle-class neighborhood and expect them to magically exhibit the traits that would have required them to earn enough money to be there – deferring gratification, working hard, etc.

I agree with the spirit (I think) of your post but not the letter. The federal government has declared war on accomplished, responsible middle and upper middle class people regardless of race. Some of these individuals can serve as useful idiots, sheepishly voting for their progressive abusers due to social issues (gay marriage, abortion). But many stray from slavish loyalty all too often. Worse, many actual vote their economic interest. Unacceptable.
I agree this is partially about “colonization”. Democrats want to spread out some of those wasted inner city votes. It will not likely make a difference in national or even statewide elections. But at the state legislature or local level it certainly might.

I have to respectfully disagree with your speculation about “Justice Bork”, Neo. Had he been confirmed, I think he would have artfully retired about 2005-06, allowing President Bush to nominate his successor for consideration by a Republican Senate . The question then is, would Bush have nominated another Roberts or another Alito?
Further speculation: Bork’s tenure would have been akin to Scalia’s. He not only would not have moved left but he would have been a powerful, eloquent voice on the right. How many decisions up to 2005-06 might have been different if we had enjoyed Justice Bork? I realize O’Connor had moved left as well, but still.

Again, you misunderstood me. This time it has to do with tone. My question about whether the Powers That Be evaluate the people on race or income was rhetorical and was meant to illustrate that I realize they can pick and choose as they wish (or use both, or whatever they want) as it may suit their purposes in any given situation.
My later remark in that same comment—about how rich white communities should just encourage more rich black people to move in—was meant to illustrate that what motivates those communities is not racism but a desire to be among people of the same socioeconomic class and values, and that black people who have achieved those things are perfectly okay with them as neighbors, ordinarily.

anyway, one of the most interesting links i had was a rapper who moved into a white neighborhood after earning enough, and before he did he was on the racist bus.
after that, he got real angry and such and said never again would he listen to those people and such and when into a honest description as to the differences in both neighborhoods.

1) he put his garbage out, and the next day, it was up on his property away from the curb. he said that he thought the white folk moved it there to cause him ill. later a white neighbor came and told him that if he puts his trash out on the wrong days he will get an expensive fine from the city, so they moved all of that back off the curb so he would not lose his money
2) he was getting a big tv, and it was delivered to his porch. but when he got home it was gone. again, a neigbor came by and said, we held if for you so nothing would happen, then helped him bring it in. he said that in the hood, it would just be gone, or damaged.
3) came snow time, and he didnt have a shovel, so he went to borrow one. not only did they loan him one, but several neigbors came to help him clear the area.
this was also true in the south in many cases, which is why the people running the highlander school had to plant explosives and light fake crosses on yards after they played games presenging themselves as white to buy a home, and moving blacks in. when the racist southerners didnt care and follow the script they wanted to use politically, they blew them up with dynamite…
these were the same people who tried to blow up part of brooklyn and get the jews of the JDL blamed… to this day, the jews and blacks in that area do not get along and are at each other.
