The state has agreed to have “sudden passion” added among the items to be considered. If the jury accepts this addition, the possible sentence is reduced from a maximum of 99 years to a maximum of twenty.

Texas law only creates a difference between capital murder and murder.” So in this case was between murder and manslaughter, or it may be called criminally negligent (or reckless?) homicide.
