In the situation, what might have been better? Penny or some similarly-motivated individual goes to stand between Neely and the other passengers. They feel safer.

Either this doesn’t stop Neely from approaching the passengers, or it triggers him. In either case, he may actually strike our hero first. In which case the latter puts in a move far more likely to be lethal or seriously injuring than the plan for a submission hold. You have to be really, really good to change a strike into a submission hold…before the next strike.

Okay. Neely’s dead or seriously hurt.

Prosecute? In NYC, yes. Penny is white and taunted Neely, anticipating Neely making a move which would excuse Penny murdering him, poor guy. What else was Penny expecting, the racist.
I figure they get the Rittenhouse prosecution team and offer them the racial lineup of their dreams.
This presumes Neely’s hypothetical first strike doesn’t include a knife or something and Penny’s dead or disabled.

I keep saying that I not only refuse to live in a blue city or blue state, but I will also strive diligently to avoid traveling in one. Why would anyone submit themselves to blatantly unfair and unjust Kafka-esque nightmares where some drugged street person can force you into a choice between dying or living the rest of your life in prison simply for defending yourself honorably?

What it does mean, though, is that she’s perfectly fine that others be attacked by the same people who attacked her…even if, no doubt, she hopes it won’t have to come to that.
